Natos nya stadga har gett världen ett nytt ord för krig: “krisreaktionsoperation som inte utförs enligt stadgans artikel 5”. Men Nato bryter mot internationell rätt. FN måste hantera krisen på Balkan.

“NATOS KRIG mot Jugoslavien handlar framförallt om att slå fast en ny strategi för militärorganisationen”, säger Michael Klare, under en diskussion om kriget under fredskonferensen i Haag. Klare är amerikansk professor från PAWSS, Peace and World Security Studies.

Nato fyllde 50 år den 23 april. – När Clinton inledde bombningarna den 24 mars hade Nato bråttom. Jugoslavien skulle kapitulera i god tid före den 23 april, fortsätter Klare. Nu gällde det Natos framtid och USA:s nya strategiska doktrin som ensam supermakt. Därvid offrades det kosovoalbanska folket. Alla med kunskap om Balkan visste att bombningar skulle skapa en humanitär katastrof. CIA och Pentagon varnade politikerna, som inte lyssnade.

– Man startade bombningarna utan någon som helst planering för att hantera den kommande flyktingsituationen.

Till råga på allt kallade man operationen för en “humanitär intervention”.

UNDER NATOS 50-årsjubileum antogs en ny doktrin för organisationen. Från att ha varit en renodlad försvarsorganisation är Nato nu något annat, en regional polisstyrka, som kan sättas in var som helst i Europa, i Nordafrika, i Mellanöstern.

I den nya stadgan har bombningarna av Jugoslavien getts en definition.

– Vi har fått ett nytt ord för krig, säger Michael Klare, “non-article 5 crisis response operation”.

På svenska blir det ungefär, en “krisreaktionsoperation som inte utförs enligt stadgans artikel 5”.

I artikel fem av Natos stadga heter det att en attack mot ett Natoland kommer att besvaras kollektivt av Nato. Den principen har varit Natos förutsättning från 1949 till nu. Den ovan citerade nya formuleringen finns i artikel 41, som ger Nato rätt att ingripa också utan att något Nato-land har angripits. I stadgetexten heter det vidare att den nya formen för insats “kan vara lika krävande som ett artikel 5-krig”.

I SVERIGE har frågan om internationell rätt diskuterats i många röstlägen sedan bombningarna inleddes och med de mest besynnerliga argument.

I Haag framträder Peter Weiss, jurist med internationell rätt som specialitet.

– FN-stadgan artikel 2 begränsar rätten att föra krig till a) självförsvar och b) fall som auktoriserats av FN. – Natos bombningar strider därmed mot FN-stadgan.

Vidare gäller det sättet på vilket kriget förs.

– Nato bryter mot humanitära lagar genom att bomba civila mål, som TV-stationen i Belgrad. Och när man bombar oljeraffinaderier bryter man också mot de konventioner som förbjuder vållande av miljökatastrofer.

Dunja, en serbisk kvinna, tidigare verksam i demokratirörelsen i Novi Sad och nu flykting i Ungern, säger:

– Nato vill inte hjälpa varken albaner eller serber. I min stad har de tre gamla broarna förstörts av bomber. Universitet och skolor fungerar inte sedan bombningarna började. Veckovis har vi varit utan el och vatten. Också vattensystemet har bombats. När oljeraffinaderiet bombades föll under lång tid ett svart regn som gjorde alla grönsaker oätliga. Dessutom är vi alla rädda för radioaktivt uran i Natos vapen.

Phon van den Biesen är holländsk jurist som representerar Bosnien-Hercegovina vid Krigsförbrytartribunalen, därtill specialist på internationell rätt och miljölagstiftning.

– Jag har studerat kriget i Bosnien och dess orsaker och demonstrerar för domstolen hur icke-serber utsattes för folkmord, något som regimen i Belgrad har ett direkt ansvar för. Nu kan jag se att något liknande sker i Kosovo, att många albaner blivit offer för folkmord.

– Som advokat är jag samtidigt oroad över att internationell lag åsidosatts av Nato. Jag håller med Peter Weiss om att Natos bombningar är ett kristallkart brott mot FN-stadgan.

Randy Forsberg representerar organisationen Global Action to Prevent War.

– Natos krig är illegalt. Men inte bara det. Det fungerar inte. Situationen nu, efter snart två månaders bombningar, är mycket värre än när kriget inleddes.

Randy Forsberg kunde inte acceptera att FN ersatts av Nato.

– Under Gulfkriget kidnappades FN av Nato. Nu är det än värre. USA struntar i FN. Men en militärallians ser bara militära lösningar. Det som behövs nu är förhandlingar, inte med falska diplomater som Richard Holbrooke utan med verkliga förhandlare som Kofi Annan. Nya möjligheter kan bara skapas av FN – inte av Nato.

PÅ ETT ANNAT av Haagkonferensens seminarier diskuterade fredsforskaren Johan Galtung två olika förhållningssätt till konflikter som den i Kosovo.

– Man reducerar gärna konflikten till bara två parter och tar ställning för och stöder den ena. Det är mycket mänskligt. Men det leder inte till fred.

– Alternativet är att ta ställning mot våldet. Då måste man förstå att våld uppstår ur en olöst konflikt, där parterna har oförenliga mål. Bara en medlare som kommer utifrån och inte har egna intressen i konflikten kan först arbeta med att förstå hur parterna tänker och sedan hjälpa dem med att finna sätt att öppna oväntade dörrar.

Galtung betonade också att Balkan måste behandlas som en helhet om man vill skapa fred i sydöstra Europa. – Flyktingarna från Kosovo måste kunna återvända. Men det gäller också andra flyktinggrupper på Balkan, också de 700.000 serbiska flyktingar från Kroatien och Bosnien som nu finns i Jugoslavien.

VAD GÖR VI för att förhindra framtida Kosovos och Rwandas? – Grundläggande är att förstärka FN-systemet, underströk Tim Barner, från World Federalist Association. FN tillsammans med regionala säkerhetsorganisationer (som OSSE) och olika icke-regeringsorganisationer (så kallade NGO:s, non-gouvernemental organisations, vilket kan stå för allt från Röda Korset till små frivilligorganisationer) kan arbeta tillsammans med konfliktlindrande åtgärder.

Det handlar om att skapa förutsättningar för tidiga varningssignaler, för rapporter om kränkningar av mänskliga rättigheter och minoritetsrättigheter, men också om att reformera FN.

– Vid FN borde finnas en permanent grupp professionella kompetenta medlare. FN borde ha en stående polisstyrka som kan rycka ut med kort varsel. Säkerhetsrådets vetoregler måste förändras. Utbildning av politiska ledare i konfliktbeteende är en annan möjlighet.

Sedan behöver FN en annan finansiering. I dag saboteras FN av USA som fortfarande inte betalt en skuld på över tio miljarder. Samma USA gör ensamt av med 25 miljarder kronor i månaden på att bomba sönder Jugoslavien.

– Det finns många möjligheter (och svårigheter), underströk Jack Loretty och räknade upp några.

  • En avgift till FN på all vapenhandel.
  • FN-skatter på flygbiljetter, på olja och/eller tobak.
  • En internationell valutaväxlingsavgift skulle minska risken för spekulation i enskilda valutor. Om skatten sätts till 0.05 procent skulle enligt organisationen Earth Action ge FN 150 miljarder om året. Problemet är, säger Loretty, att den amerikanska rabiat FN-fientliga högern är extremt negativ till FN överhuvud och särskilt till varje form av “FN-skatt”.

Ska vi i den övriga världen bara acceptera att en sådan opinion ska avgöra FN:s öde?

1992 blockerades FNs fredsbevarande operation till Somalia. Den var för dyr hette det. Något liknande skedde senare med Rwanda, där FN bad 35 länder om fredsbevarande trupper. Men inget land sa ja. 800.000 människor dödades.

När det gäller Kosovo och Jugoslavien har kriget lett till en humanitär katastrof med omkring en miljon flyktingar och omfattande förstörelse. Jonathan Dean från Union of Concerned Scientists uppskattar omvärldens kostnad för krisens konsekvenser under de kommande två åren till över 400 miljarder kronor. Så mycket står på spel om ingenting görs på ett tidigt skede, om inte FN har tillräckliga resurser.

KRIGET MOT JUGOSLAVIEN är också ett krig mot FN. Världens mäktigaste stat värnar om sin hegemoni, sitt världsherravälde, där FN snarast är ett hinder.

Men varför accepterar den övriga världen en sådan hållning? Och varför har regeringen i traditionellt FN-vänliga Sverige gjort så lite för att motsätta sig en sådan ordning?
