PressInfo #57 – Procitajte civilni deo Sporazuma o Kosovu!

“Procitajte tzv. Sporazum o Kosovu, isti onaj o kom se
upravo ovih sati raspravlja u Parizu i budite sigurni da ce
vas puno toga sto on sadrzi zaista iznenaditi”, kaze Dr. Jan
Oberg, direktor TFF-a. ” Mislim da ni jedna suverena drzava
ne bi prihvatila sve CIVILNE odredbe a tako ni VOJNU
implementaciju predvidenu ovakvim planom. Nijedna drzava
nije odusevljena kad joj prete ultimatumom tipa “potpisi ili
cemo te bombardovati” a pogotovo ne kada takav navodni plan
u sebi de-facto sadrzi i kraj nje same kao suverene drzave
sa vlastitim teritorijalnim integritetom.

Uobicajeni izvestaji CNN-a, BBC-a i vodecih listova
prenose svetskoj javnosti utisak kako su bas Srbi ti koji
tvrdoglavo odugovlace pregovore o miru, dok je Albanska
strana kooperativna, sto se vidi i iz pisma sefa njihove
delegacije od 15. marta. Jugoslaviju treba kazniti dok
Albance treba pohvaliti zbog njihove “hrabrosti da naprave
ustupke kako bi se doslo do mira.” No to je samo lazna
slika, opsena i obmana. Prava slika je kudikamo
komplikovanija od ovoga” kaze Oberg.

“Mora da ste vec primetili kako niko ne postavlja jedno
savim prosto i logicno pitanje: Da li mozda postoji neki
RAZLOG za to sto Srbi kazu ‘ne’ a Albanci nagovestavaju kako
bi mozda mogli reci ‘da’? Zapitajte se zbog cega i mediji i
diplomati analiziraju jedino nacin na koji se vodi igra a ne
analiziraju i njenu sustinu. Da li VI oupste znate” pita Jan
Oberg “da dokument koji je stavljen na sto izmedju ostalog
sadrzi i sledece odredbe:

* samoupravno Kosovo sme da utice na jugoslovensku
politiku dok istovremeno vlastima SRJ nije dozvoljeno da se
mesaju u unutrasnje stvari na Kosovu? Ni SRJ ni Srbija ne
smeju da izmene Ustav ili druge zakone Kosova dok ce u isto
vreme gradjani Kosova i dalje biti birani u Saveznu i
Republicku Skupstinu, u obe vlade i sve sudove;

* Nigde nisu definisane “nacionalne zajednice” –
izraz koji se provlaci kroz citav dokument kao jedna od
njegovih osnovnih kategorija – no svejedno dokument govori o
njihovoj “postenoj zastupljenosti” kao i o njihovim
“dodatnim pravima”.

* (Ovaj) Sporazum nadjacava bilo koji drugi zakonski akt, tj. jugoslovenski zakonski akt?

* Svi ce imati jednaka prava i jednak pristup
javnim sluzbama, no uopste nije objasnjeno niti se vidi kako
ce to pravo ostvarivati 10 – 20 procenata stanovnistva
pokrajine koji NISU Albanci;

* Misija za Implementaciju sporazuma imace svoje vlastite radio i televiziju na Kosovu;

* SRJ ce biti onemogucena da istrazuje zlocine
vezane za ovaj sukob a Sporazum donosi i to da prethodne
politicke ili druge aktivnosti u pokretu otpora nece
predstavljati smetnju za buduce nosioce sluzbenih ovlascenja
na Kosovu;

* Svi organi vlasti u SRJ ce biti duzni da provedu sve odluke koje donese Vrhovni Sud Kosova;

* Dozvoljena je promena opstinskih i komunalnih
granica – sto kao verovatnu posledicu moze da izazove razne
manipulacije oko izbornih jedinica sa ciljem da se stvore
kompaktne jedinice sa sigurnom vecinom;

* OEBS ce nadgledati izbore uz konsultacije sa svim stranama; SRJ se ne smatra sposobnom da sama organizuje izbore;

* ef OEBS-ove i EU Misije za implementaciju (CIM)
ce biti ovlascen da svim stranama uputi obavezujuce
direktive po vlastitom nahodjenju i u vezi bilo cega za sta
sam zakljuci da je potrebno; isto kao i u Bosni, i ovde ce
on biti ovlascen da otpusti osoblje sluzbe javne bezbednosti
ili da sam smeni ili postavi javne sluzbenike i da pritom
zaobidje ili preskoci postojece institucije – sto znaci da
moze da ponisti i rezultate izbora; mogucnost da SRJ moze da
stavi veto na bilo koju odluku jednostavno nije
predvidjena;

* Kosovo ce se organizovati kao slobodna trzisna privreda, kako je i predvidjeno u njegovom “ustavu”;

* SRJ ce ustupiti Kosovu ravnopravan udeo u
prihodima od svih medjunarodnih transakcija dok ce privredni
potencijal i prihodi same pokrajine biti prerasporedjeni
prema “rasporedu ovlascenja i odgovornosti predvidjenih ovim
Sporazumom.” Tesko je reci da ovo pojasnjava sta ce se
uraditi sa znacajnim prirodnim bogatstvima i industrijskim
postrojenjima u pokrajini;

* Obecana je i znacajna privredna pomoc i
odrzavanje donatorske konferencije. Ni pomena nema o bilo
kakvoj pomoci kojom bi se normalizovalo stanje u
jugoslovenskoj privredi, ukinule joj se sankcije ili na bilo
koji drugi nacin pomoglo 650.000 izbeglica koji se nalaze u
SRJ, najveci broj u bilo kojoj pojedinacnoj zemlji
Evrope;

* Za tri godine ce se sazvati medjunarodni
sastanak na kom ce se “utvrditi mehanizmi za konacno resenje
za Kosovo, na osnovu narodne volje, misljenja odgovarajucih
organa” itd. Ne govori se nista o tome ko ce sazvati taj
sastanak, Kontakt grupa se do tada moze promeniti ili
raspasti ili je moze zameniti neko drugo telo. Zasto se ne
koristi rec “referendum”? Ukoliko je istina da su 85%
stanovnika Kosova Albanci, nije tesko pogoditi da narodna
volja u stvari znaci nezavisno Kosovo. Jasno je da i Srbi na
Kosovu a i oni u SRJ to znaju dok sam dokument to precutkuje
dok na pr. istovremeno ne predvidja nikakve odredbe po
kojima se eventualno nezavisno Kosovo ne bi smelo ujediniti
sa Albanijom.

* Na samom kraju, u ovom, civilnom delu dokumenta
potpuno nedostaje bilo kakav spomen gradjanskog
obezbedjivanja mira, mera za uspostavljanje poverenja,
pomirenja na osnovama gradjanskog drustva, radionica o
razresavanju sukoba, podrske nevladinim organizacijama,
obucavanja, treninga za mir i zastitu ljudskih prava, itd.
Na taj nacin sanse da ce kroz ove tri godine Albanci, Srbi i
ostali gradjani zaista poceti da izgradjuju medjusobno
poverenje i da uce kako da miroljubivo zive jedni pored
drugih, ostaju ravne nuli.

Ovaj tekst krije dve vrste semantickih varki: Prva je ta
sto se u njemu Jugoslavija, jedna suverena i priznata drzava
kroz jezik kojim je pisan i kroz odredbe koje on sadrzi
tretira na potpuno istoj ravni sa albanskom
samo-proglasenom, nepriznatom drzavom Kosovo i sa njenim
vojnim jedinicama, Oslobodilackom vojskom Kosova, OVK. Kako
bilo da bilo, to je ipak pravni dokument i kao takav navodi
da se 70-80 procenata u njemu izlozenih odredbi odnosi na
SRJ a ne i na Kosovo, jer – boze moj- samo prvo-pomenuta ima
sve institucije, pravna sredstva i snagu potrebnu da ovaj
sporazum i sprovede. Tako kada se na mnogo mesta u Sporazumu
procita “Strane se obavezuju” to se u stvari odnosi samo na
SRJ.

Drugi trik je taj sto dokument ponavlja na puno mesta
kako se “postuju suverenitet i integritet Jugoslavije” dok
se istovremeno uveliko mesa i u jedno i u drugo i to na dva
izrazena nacina: a) uspostavljanjem ocigledno asimetricnog
rasporeda medjusobnih mogucnosti uticanja i obaveza izmedju
SRJ i samo-upravnog Kosova i b) postavljanjem efa civilnog
dela Misije za implementaciju, CIM, za de-facto vladara
pokrajine, a prema modelu iz Dejtonskog Sporazuma i po
ugledu na tako nastali tamosnji Ured visokog
predstavnika.

Dokument je svima na uvidu i dostupan je preko Interneta.
Kako to da niko jos nije analizirao ove stvari? Kako to da
se nije pokrenula strucna debata o tome koliko ovo jeste ili
nije posten sporazum koji ce dovesti do uspostave mira i
poverenja? Zbog cega je sva paznja javnosti usmerena na samu
igru pa niko ne (zeli da) vidi koja su tu ona prava i
sustinska pitanja i problemi? Ovo nije neki obican sportski
dogadjaj! Ovde su u igri sudbine oko 10 miliona ljudi i
njihovih buducih pokolenja.

Po svemu sto ja vidim, NIJEDNA zapadna drzava – a sigurno
ne ni jedna od clanica Kontakt grupe, ne bi cak ni pomislila
da odobri neku samoupravu kao sto je ova ovde zacrtana, a na
koju bi je prisiljavali vojnim pretnjama i sporazumom o
vojnoj implementaciji” kaze dr. Oberg, koji je sa TFF
pregovarackim timom aktivno prisutan u ovom konfliktnom
regionu jos od 1992. U svom zakljucku on jos kaze i ovo:

“Poglavlje 7, Vojna Implementacija Sporazuma, jos je
najinteresantnije. Zadovoljni smo sto cemo vam u sledecoj
Press Informaciji moci prikazati i ovaj deo Sporazuma. Jeste
li znali da se u citavom tekstu Sporazuma nigde ne spominje
rec OVK? Da Sporazum predvidja da NATO treba da postane
najvisi vojni autoritet na tom delu teritorije suverene
Jugoslavije? Da se Jugoslaviji sprecava da sama definise
odbranu vlastitih granica a da se nigde u Sporazumu ne
definise demilitarizacija OVK? No, o tome vise u TFF Press
